Many of the first haunted houses were associated with\ncorporations. Yet, it was the nonprofit sector that made haunted houses a part\nof Americana. <\/p>\n\n\n\n<p>In recent year\u2019s haunted houses started to fade.\u00a0 Sponsoring organizations such as churches, and school groups, have backed away.\u00a0 Like so many other things in our lives, the culprit is government red tape. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Personal Injury Claims and Haunted Houses <\/h4>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright\"><img loading=\"lazy\" decoding=\"async\" width=\"225\" height=\"225\" src=\"https:\/\/www.insuringky.com\/blog\/wp-content\/uploads\/2019\/09\/Haunted-House-1a.png\" alt=\"Are you or a group you're involved with, having a haunted house this season? We can point to three factors that significantly contributed to\nthis:<\/p>\n\n\n\n<p>Consumers can readily identify and assume the risk<\/p>\n\n\n\n<p>Haunted houses are open for only a brief time each\nyear.&nbsp; The risk of something going wrong\nincreases with time.&nbsp; Since these events\nare seasonal dangerous conditions are less likely to develop. <\/p>\n\n\n\n<p>Proof!&nbsp; Claims of\ninjury or damages were often dismissed due to lack of proof.&nbsp; What&#8217;s changed?&nbsp; Cell phones!&nbsp;\n<\/p>\n\n\n\n<p>Access to information relative to compensation for injuries or damages.\u00a0 <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">It\u2019s not the haunted house; it\u2019s the Attorneys that scare me!<\/h4>\n\n\n\n<p>That was the past.  If someone is injured at a Special Event today, they are much more likely to seek compensation.  Recently I did an online search for \u201cHaunted Houses.\u201d I should have known better. But the truth is, what I found was horrifying. On page one of my search results was a blog post from a personal injury attorney.<\/p>\n\n\n\n<p>Times have changed.&nbsp;\nSeasonal Events have become considerably riskier.&nbsp;&nbsp; If you are planning a haunted house,\nhayride, or any other seasonal event, take a moment an to consider the\nrisk.&nbsp;&nbsp; It\u2019s also wise to reach out to an\nindependent insurance agent for input. Most agents will likely recommend\ninsurance if appropriate. They may also provide insights into your\nprocess.&nbsp; Identifying opportunities to\nreduce or avoid risk.&nbsp; They should also\npresent products to transfer risks associated with production. Some of the more\ncommon suggestions are:<\/p>\n\n\n\n<p>Waiver or Release <\/p>\n\n\n\n<p>Before allowing entry most all require a signed release or\nwaiver of liability.&nbsp; As long as the\ndisclosures describe the risk, consumers to sign the waiver assume the risk. <\/p>\n\n\n\n<p>Limited Liability Company (LLC) or Incorporate (Inc.)<\/p>\n\n\n\n<p>Setting up a business entity is an excellent way to limit\nliability. Undertakings done with these corporate structures are separate from\nyour personal assets. <\/p>\n\n\n\n<p>General Liability Insurance<\/p>\n\n\n\n<p>General Liability Insurance protects a business against\nbodily injury or property damage claims. Tripping over a cord, cuts caused by\nexposed nails, injuries or losses caused by chemicals, and falling props: are a\nfew examples where GL coverage would provide protection.<\/p>\n\n\n\n<p>Workers Compensation Insurance<\/p>\n\n\n\n<p>Work Comp protects employees that become injured while\nworking for you. If your special event has employees, you need this coverage.\nThere are very few exceptions to this. Special rules apply to partners,\nsub-contractors, members, and volunteers. Call an Independent Insurance Agent\nfor a better understanding of your requirements.<\/p>\n\n\n\n<p>Property Insurance<\/p>\n\n\n\n<p>Your Special Event may alter coverage needs on buildings\nthat you own or lease. It is essential to discuss your event with your\ninsurance agent.<\/p>\n\n\n\n<p>Inland Marine<\/p>\n\n\n\n<p>You may use mobile equipment or other property in your\nhaunted house or corn maze.&nbsp; This should\nbe covered with inland marine coverage.<\/p>\n\n\n\n<p>Commercial Auto<\/p>\n\n\n\n<p>Most automobiles used in your Special Event will already\nhave coverage. The question is, will they have enough? Unless your vehicles are\nowned by an LLC or other business, then your entity is exposed. It needs to be!\nIn the event of legal action, your organization most likely will be named in\nany lawsuits. To protect yourself from this, you should consider Hired and Non-Owned\nCoverage.<\/p>\n\n\n\n<p>Volunteer Accident Insurance<\/p>\n\n\n\n<p>Injuries to employees are covered by the work comp policy. But what happens if a volunteer is injured? They can most likely be covered by purchasing a Volunteer Accident Policy. However, there are many gray areas where you might run aground.\u00a0 We suggest that you speak with an independent Insurance Agent beforehand. <\/p>\n\n\n\n<p>Fall is the season for haunted houses, corn mazes, and other\nseasonal events.
